An expungement has two practical stages: obtaining the court order and making sure the agencies that hold the records implement it. Those are related, but they are not the same event.
New Jersey Uses a Dedicated Expungement System
The Judiciary’s eCourts Expungement System handles electronic expungement petitions. It can retrieve court history, generate case information, serve required agencies, receive prosecutor objections, and distribute entered orders.
Attorneys do not file expungements through ordinary eCourts Criminal. The Judiciary directs expungement filings to the separate expungement system.
What the Petition Must Identify
N.J.S.A. 2C:52-7 requires a verified petition containing core information such as date of birth, arrest date, charges, complaint or indictment number, disposition, conviction date, and sentence. The petition is filed in the Superior Court in the county where the petitioner resides or a county in which one or more matters were disposed of.
Prosecutor Review and Objections
The eCourts process sends the petition to the county prosecutor and other required agencies. Judiciary Directive #05-23 describes the system as allowing the prosecutor 60 days from the filing of the initial petition to submit an objection and allowing the petitioner 30 days to reply to an objection.
An objection does not automatically defeat the petition. It identifies the legal or factual issue the court must decide.
Some Cases Require a Hearing
If the record is straightforward and no material objection exists, the matter may be resolved without a contested hearing. When eligibility, payment history, related convictions, or another statutory question is disputed, the court may need a hearing and supporting evidence.
The Order Must Be Implemented
Once the judge grants expungement, the order is distributed to the agencies that hold the affected records. Processing takes time because each agency must update or isolate its own records.
The State Police is now legally bound to process expungement orders within 120 days of receipt, subject to limited exceptions, and aims for a 90-day turnaround. In September 2026, the Office of the Public Defender reported that most orders were being processed in roughly 60 to 90 days.
Petitioners can track State Police processing through the NJSP Expungement Status Portal using the XP docket number from the granted order.
What Changes After Expungement
N.J.S.A. 2C:52-27 provides that, unless another law says otherwise, the arrest, conviction, and related proceedings are deemed not to have occurred and the person may generally answer questions accordingly.
There are exceptions. Prior diversionary expungements must be disclosed to a court deciding admission into a later diversion program, and expunged information must be disclosed for certain employment within the Judiciary, law enforcement, or corrections. Other provisions of Chapter 52 permit use of expunged records for specified criminal-justice purposes.
Verify Completion
The practical endpoint is not merely receiving a signed order. The record should be checked after the agencies have had time to process the order, especially when employment, licensing, or another background check is the reason for seeking relief.
